Terms of Service

By accessing or using Lakefront Finder ("the Platform," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Platform.

We reserve the right to modify these terms at any time. Material changes will be communicated to registered users via email. Your continued use of the Platform after changes constitutes acceptance of the revised terms.

To use Lakefront Finder, you must:

• Be at least 18 years old.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate and complete registration information.
• Not have been previously suspended or removed from the Platform.

By using the Platform, you represent and warrant that you meet all eligibility requirements.

When you create an account, you are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access or use of your account.
• Ensuring your account information remains accurate and up to date.

We reserve the right to suspend or terminate accounts that violate these terms, contain false information, or are used for fraudulent purposes.

By creating a property listing on Lakefront Finder, you represent and warrant that:

• You are the legal owner of the property or are authorized to list it on behalf of the owner.
• All information provided in the listing is accurate, complete, and not misleading.
• All photographs are genuine representations of the property and you have the rights to use them.
• The property is lawfully available for sale or rent as described.
• The listing complies with all applicable local, state/provincial, and federal laws.

We reserve the right to review, modify, or remove any listing that violates these terms, contains inaccurate information, or is otherwise deemed inappropriate. Listings are subject to our review process before being published.

Lakefront Finder is a marketplace platform. We do not act as a real estate broker, agent, or advisor. We do not guarantee the accuracy of any listing information or the completion of any property transaction.

You agree not to:

• Post false, misleading, or deceptive listing information.
• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Harass, threaten, or abuse other users of the Platform.
• Scrape, crawl, or use automated tools to extract data from the Platform without prior written consent.
• Attempt to bypass security measures or gain unauthorized access to systems or accounts.
• Post spam, unsolicited advertisements, or commercial messages through our inquiry system.
• Impersonate another person or entity, or falsely represent your affiliation.
• Upload malicious code, viruses, or any harmful content.
• Interfere with the proper functioning of the Platform.

Listing fees and any other charges are described on our pricing page and at the time of purchase. All fees are in the currency displayed at checkout.

• Listing Fees: fees are charged at the time of listing submission and are non-refundable once the listing has been published.
• Refund Policy: if a listing is rejected during our review process, you will receive a full refund. Once published, listings are non-refundable.
• Price Changes: we may change our fees at any time. Changes will not affect existing active listings but will apply to new listings and renewals.

All payments are processed securely through our third-party payment processor. By making a payment, you also agree to the payment processor's terms of service.

The Platform, including its design, logos, text, graphics, and software, is owned by Lakefront Finder and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

By posting content to the Platform (including listing descriptions and photographs), you grant Lakefront Finder a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and promoting the Platform. You retain ownership of your content.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Guarantees that the Platform will be uninterrupted, error-free, or secure.
• Accuracy or reliability of any information provided through the Platform, including property listings.

Lakefront Finder does not verify the accuracy of property listings, the identity of users, or the legality of any property transaction. You are solely responsible for conducting due diligence before engaging in any property transaction.

To the maximum extent permitted by law, Lakefront Finder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Platform.

Our total liability for any claim arising from your use of the Platform shall not exceed the amount you have paid to Lakefront Finder in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Lakefront Finder and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Platform.
• Your violation of these Terms of Service.
• Your violation of any rights of another party.
• Any content you post on the Platform, including property listings.

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Platform ceases immediately.
• Active listings will be removed from public view.
• We may retain certain data as required by law or for legitimate business purposes.
• No refunds will be issued for unused portions of paid listings.

You may also delete your account at any time through your account settings. Provisions of these terms that by their nature should survive termination will remain in effect.

These Terms of Service are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota. You consent to the personal jurisdiction of such courts.
